Please read this Agreement carefully before using StackSeek. By accessing or using the Service you agree to be bound by these terms. If you do not agree, do not use the Service.
"StackSeek", "we", "us" or "our" refers to the operator of the StackSeek service available at stackseek.ai (the "Service"). "You" or "User" means the individual or legal entity accessing the Service. The Service is a buyer-facing AI research platform for enterprise software selection.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal evaluation purposes. You may not resell, sublicense, scrape at scale, reverse engineer, or use the Service to train a competing AI system.
You are responsible for activity under your account and for keeping credentials secure. You agree not to use the Service unlawfully, to upload harmful content, to attempt unauthorized access, or to interfere with other users.
The Service uses large language models and automated research pipelines to produce vendor information, comparisons, dossiers, and recommendations. AI output can be incomplete, out of date, biased, or simply wrong ("hallucinated").
We do not guarantee that any data, answer, vendor description, capability claim, pricing, comparison, or recommendation presented by the Service is accurate, complete, current, or fit for any particular purpose. All output is provided "as is" and "as available" for informational purposes only and does not constitute professional, legal, financial, or procurement advice. You are solely responsible for independently verifying any information before relying on it for a purchasing decision or other action.
StackSeek is an AI-enabled service within the meaning of Regulation (EU) 2024/1689 (the "EU AI Act"). In line with the Act's transparency obligations:
We process personal data in accordance with Regulation (EU) 2016/679 ("GDPR") and applicable national implementations. For personal data you submit or that we collect about you, StackSeek acts as the data controller, unless we have agreed otherwise in writing (e.g. an enterprise data processing agreement).
Under the GDPR you have the right to access, rectify, erase, restrict, port, and object to processing of your personal data, and to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your national supervisory authority. To exercise any of these rights, contact us at privacy@stackseek.ai. We will respond within one month.
We retain personal data only as long as necessary for the purposes above, after which it is deleted or anonymized. Account data is retained for the lifetime of your account plus a limited period for legal and accounting requirements.
Where personal data is transferred outside the European Economic Area, we rely on adequacy decisions or the European Commission's Standard Contractual Clauses, with supplementary measures where appropriate.
The Service produces AI-assisted recommendations but does not make decisions that produce legal or similarly significant effects about you within the meaning of Art. 22 GDPR. Recommendations are advisory and require human review.
We do not use your private subscriber context (e.g. your stack, constraints, or private notes) to train third-party foundation models. Aggregated and de-identified usage data may be used to improve our own ranking, retrieval, and evaluation systems.
When you bookmark or highlight a vendor, offering, category, or dossier section, we store that bookmark against your account so you can find it again in your highlights workspace. Your individual bookmarks are private to you and visible only via your authenticated session.
We may share aggregated, anonymized bookmark counts with vendors and domain partners (e.g. "X buyers saved this strength"). Such aggregates are only published when the underlying data covers at least three (3) distinct buyers for the same segment, so that no individual user can be re-identified. We never share your identity, email, employer, IP address, or the full set of items you have bookmarked with any vendor or third party. You can remove a bookmark at any time from your highlights page; removal is reflected in future aggregates.
The Service surfaces information about third-party vendors gathered from public sources, vendor-supplied claims, and AI synthesis. Mention of a vendor is not an endorsement. Trademarks and product names belong to their respective owners.
The Service, including its software, design, taxonomies, and original written content, is owned by StackSeek and protected by intellectual property laws. You retain ownership of content you submit and grant us a worldwide, non-exclusive license to host and process it for the purpose of providing the Service to you.
Free tier features are provided at no cost. Paid tiers are billed per the pricing page. Fees are non-refundable except where required by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED OUTPUT. NOTHING IN THIS SECTION LIMITS RIGHTS THAT CANNOT BE EXCLUDED UNDER MANDATORY LAW (INCLUDING EU CONSUMER LAW).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STACKSEEK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR PROCUREMENT DECISIONS MADE IN RELIANCE ON THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR EUR 100 IF YOU USE ONLY THE FREE TIER. NOTHING IN THIS AGREEMENT LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER MANDATORY LAW.
You may stop using the Service at any time. We may suspend or terminate access for breach of this Agreement or to comply with law. Sections that by their nature should survive (IP, disclaimers, liability, governing law) survive termination.
We may update this Agreement to reflect product or legal changes. We will post the new version with an updated effective date and, where the change is material, notify you in-product or by email before it takes effect.
This Agreement is governed by the laws of the European Union member state in which StackSeek is established, without regard to conflict-of-laws principles. Mandatory consumer protections of your country of residence still apply.
